New EU ELV Regulation Takes Effect This Month: 15% Mandatory Recycled Content Sets "Closed-Loop" Test for Automotive Plastics Supply Chain
By Our Reporter The EU Regulation on circularity requirements for vehicle design and on management of end-of-life vehicles (Regulation (EU) 2026/1738) entered into force on 13 August and will apply from 1 September 2028, fully replacing the ELV Directive (2000/53/EC) and the RRR Directive (2005/64/EC) that have governed the sector for more than two decades. For Chinese automotive plastics suppliers - whose export strength lies in polypropylene parts such as bumpers, instrument panels and door panels - the regulation turns recycled content from a bonus into a market-access requirement.
At the heart of the regulation is a first-ever mandatory recycled content target for automotive plastics: new vehicle types approved from 1 September 2032 must contain at least 15% recycled plastic, rising to 25% for types approved from 1 September 2036. Equally consequential is the "closed-loop" clause - at least 20% of that recycled content must come from end-of-life vehicles or used parts, meaning roughly 3% (at the six-year mark) to 5% (at the ten-year mark) of a vehicle's total plastic mass must be traceable back to the automotive cycle itself. The regulation also retains the existing targets of 85% reusability/recyclability and 95% reusability/recovery by weight, and for the first time extends its scope beyond passenger cars and light commercial vehicles to heavy-duty vehicles such as buses and trucks.
The pressure extends beyond material ratios. The regulation strengthens extended producer responsibility (EPR), holding producers financially accountable for the entire vehicle lifecycle - including once the vehicle becomes waste - and introduces traceability obligations such as electronic certificates of destruction and electronic record-keeping. Under the regulation's text, the European Commission must adopt implementing acts by 31 December 2026 setting out how recycled plastic content is calculated, verified and certified, potentially including independent third-party audits of recycled material manufacturers. This brings Tier 1 and Tier 2 polymer suppliers into the formal compliance chain for the first time.
The gap with industry reality remains wide: only about 19% of plastics from end-of-life vehicles in the EU is currently recycled, while Europe's automotive manufacturing sector consumes roughly 6 million tonnes of plastics a year, almost entirely from virgin feedstock. Industry consensus holds that the 15% target will be met primarily through recycled polyolefins - precisely the segment where Chinese automotive plastics exporters are strongest, and a signal that competition is shifting from "compound formulation plus mould precision" toward "traceable feedstock and verifiable batches."
Domestic policy is tightening in parallel. On 31 December 2025, seven Chinese departments led by the National Development and Reform Commission jointly issued the Action Plan for Promoting the Application of Recycled Materials, which sets a target of more than 19.5 million tonnes of annual recycled plastic output by 2030 and calls for a steady increase in the share of recycled materials used in sectors including automotive and electrical/electronic products. It specifically calls for achieving scaled application of recycled plastics first in interior and exterior trim, and encourages automakers to build closed-loop supply systems jointly with end-of-life vehicle dismantlers, recycled material processors and component manufacturers.
The two policy frameworks align closely in both timeline and approach. For automotive plastics suppliers, the window for "waiting for the detailed rules" is closing fast - the EU's verification methodology is due by year-end, while material qualification for a single vehicle model typically takes years. Those who build auditable recycled-material supply chains first will be best positioned to win the next round of OEM sourcing decisions.
